A PROCLAMATION

 

BY THE

 

GOVERNOR


TO THE MEMBERS OF THE LEGISLATURE:

 

WHEREAS, by the provisions of Section 121 of the Constitution of the State of Mississippi, the Governor is vested with the power to convene, by public Proclamation, the Legislature in Extraordinary Session whenever, in his judgment, the public interest requires it; and

 

WHEREAS, it is the Governor’s judgment that the public interest requires that the Legislature be convened in Extraordinary Session for the consideration of the matters hereinafter stated:

 

NOW, THEREFORE, I, Haley Barbour, Governor of the State of Mississippi, do hereby issue this Proclamation to convene the Legislature in Extraordinary Session, and do designate Thursday, August 24, 2006, at 9:00 a.m., as the time, and the State Capitol in the City of Jackson, Mississippi, as the place, in which said Session shall be convened; and do designate as the subjects to be considered at said Extraordinary Session, when so convened, the following matters so relating exclusively to and for no other purpose:

 

1. AN ACT TO AMEND SECTION 57 75 5, MISSISSIPPI CODE OF 1972, TO REVISE THE DEFINITION OF THE TERM "PROJECT" UNDER THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT; TO AMEND SECTION 57 75 11, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE MISSISSIPPI MAJOR ECONOMIC IMPACT AUTHORITY TO PROVIDE GRANT FUNDS TO ENTERPRISES DEVELOPING OR OWNING CERTAIN PROJECTS UNDER THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT; TO AMEND SECTION 57 75 15, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE ISSUANCE OF BONDS FOR CERTAIN PROJECTS UNDER THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT; TO PROVIDE AN INCENTIVE FOR PERSONS, CORPORATIONS OR OTHER ENTITIES TO MAKE CAPITAL INVESTMENTS FOR THE PURPOSE OF LOCATING CERTAIN TOURISM ORIENTED ENTERPRISES IN THIS STATE; TO CREATE THE TOURISM SALES TAX INCENTIVE FUND; TO AUTHORIZE INCENTIVE PAYMENTS FROM SUCH FUND TO PERSONS, CORPORATIONS OR OTHER ENTITIES THAT MAKE SUCH CAPITAL INVESTMENTS; TO AUTHORIZE THE MISSISSIPPI DEVELOPMENT AUTHORITY TO DEVELOP AND ADMINISTER A TOURISM INCENTIVE PROGRAM; TO AMEND SECTION 27 65 75, MISSISSIPPI CODE OF 1972, TO CONFORM TO THE PROVISIONS OF THIS ACT; AND FOR RELATED PURPOSES.

 

2. AN ACT TO AMEND SECTION 27 107 321, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO MAKE GRANTS TO LOCAL GOVERNMENTS FROM THE EMERGENCY AID TO LOCAL GOVERNMENTS FUND; TO PROVIDE THAT INTEREST EARNED ON MONEY IN THE FUND SHALL BE DEPOSITED TO THE CREDIT OF THE FUND TO PROVIDE THAT GRANTS FROM THE FUND MAY NOT EXCEED $3,000,000.00 AND THAT THE TOTAL AGGREGATE AMOUNT OF ALL GRANTS SHALL NOT EXCEED $25,000,000.00; TO AMEND SECTION 27 107 123, MISSISSIPPI CODE OF 1972, TO MAKE IT CLEAR THAT INTEREST EARNED ON THE DISASTER RECOVERY FUND SHALL BE DEPOSITED TO THE CREDIT OF SUCH FUND; TO AMEND SECTION 3, CHAPTER 534, LAWS OF 2006, TO PROVIDE THAT THE STATE TREASURER SHALL TRANSFER INTEREST EARNED DURING FISCAL YEARS 2007 AND 2008 ON AMOUNTS IN THE HURRICANE DISASTER ASSISTANCE FUND TO THE EMERGENCY AID TO LOCAL GOVERNMENTS FUND; TO AMEND SECTION 6, CHAPTER 17, LAWS OF 2006, TO REDUCE THE AMOUNT OF FUNDS UTILIZED FROM THE BUDGET CONTINGENCY FUND FOR PAYMENT OF MATURING BONDS AND INTEREST ON THE FULL FAITH AND CREDIT BONDS OF THE STATE OF MISSISSIPPI FALLING DUE DURING FISCAL YEAR 2007; TO PROVIDE THAT $100,000,000.00 SHALL BE UTILIZED FROM THE GULF TAX CREDIT BOND PROCEEDS FUND FOR PAYMENT OF MATURING BONDS AND INTEREST ON THE FULL FAITH AND CREDIT BONDS OF THE STATE OF MISSISSIPPI FALLING DUE DURING FISCAL YEAR 2007; AND FOR RELATED PURPOSES.

 

3. AN ACT TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION GULF TAX CREDIT BONDS IN A PRINCIPAL AMOUNT NOT TO EXCEED $100,000,000 AS AUTHORIZED BY THE GULF OPPORTUNITY ZONE ACT OF 2005 ENACTED BY THE UNITED STATES CONGRESS IN RESPONSE TO HURRICANE KATRINA; TO AUTHORIZE THE USE OF THE PROCEEDS OF SUCH GENERAL OBLIGATION BONDS TO PAY DEBT SERVICE ON ANY OUTSTANDING GENERAL OBLIGATION BONDS OF THE STATE FOR FISCAL YEAR 2007; TO PROVIDE FOR THE TERMS AND PROVISIONS OF SUCH GENERAL OBLIGATION BONDS AND THE IMPLEMENTATION OF CERTAIN PROVISIONS OF THE GULF OPPORTUNITY ZONE ACT OF 2005 RELATED TO SUCH GENERAL OBLIGATION BONDS; AND FOR RELATED PURPOSES.

 

4. AN ACT TO AMEND SECTION 27 65 17, MISSISSIPPI CODE OF 1972, TO REDUCE THE SALES TAX ON RETAIL SALES OF CERTAIN FACTORY BUILT HOMES; AND FOR RELATED PURPOSES.

 

5. TO ACT TO AUTHORIZE THE CITY OF MAGEE, MISSISSIPPI, TO ISSUE REVENUE BONDS FOR THE PURPOSE OF ESTABLISHING, DEVELOPING, CONSTRUCTING, RECONSTRUCTING, REHABILITA-TING, REMODELING, REPAIRING, IMPROVING, EXPANDING, EQUIPPING AND FURNISHING ACUTE CARE HOSPITALS AND OTHER HEALTH CARE FACILITIES OWNED BY MAGEE BENEVOLENT ASSOCIATION D/B/A MAGEE GENERAL HOSPITAL; AND FOR RELATED PURPOSES.

 

6. AN ACT MAKING AN APPROPRIATION FOR THE EXPENSES OF THE LEGISLATURE FOR THE FIRST EXTRAORDINARY SESSION OF 2006.

 

Such other matters as may be submitted by the Governor for consideration during such Extraordinary Session.
